Copyright and the dance video
Videoing a dance recital involves incorporation of the music used into
video sound track. This is a use of music that is not covered by dance
teachers’ class
licences with APRA or PPCA. For such occasions, AMCOS and ARIA have established
a joint blanket licence, the AMCOS/ARIA Licence for Dance Schools subject to
certain restrictions (see below).
Dance Studios employing professional video operations should ensure that the
video operation holds a current annual ‘Special Event Video Licence’ with
a specific licence number, OR phone AMCOS direct to check if a particular operator
is licenced. You will need to give the name and location of the video operation.
Dance Studios undertaking their own video operation should take out an AMCOS/ARIA
License for Dance Schools. NB This licence does not give permission for use of
music in a video that will be commercially marketed.
Restrictions upon the Making of an Authorised Video
Recording
(a) The recording may only be authorised under this agreement where the recipients
of the recording are the private individuals of whom the recording is made, for
those individuals’ private and domestic viewing only.
(b) The recording of any specific musical, ballet or opera is not authorised
under this Agreement. Permission for such recording must be obtained directly
from the Music Publisher or Music Publisher’s Agent from whom the rights
to stage or perform the musical, ballet or opera have been obtained.
(c) Under no circumstances is any public screening of a recording authorised
under this Agreement.
(d) The dance studio can make no more than 75 videos in the calendar year, e.g.
a studio may decide to make two copies of each of five performances and 65 copies
of their end-of-year recital, giving a total of 75 videos made.

If an organisation or individual wishes to produce more than 75 copies of a dance
recital, then it is seen to be in the commercial sphere. This means the producer
would have to secure agreement from music publishers and record companies of
every musical work used in the recital, for the purpose of making a specific
number of videos. This is another story!
